2023 Walking Tour Waiver

    In consideration of being given the opportunity to participate in the Walking Tour of Seattle (“Tour”) being provided by Lifesavers Conference, Inc., (“Lifesavers”) I hereby agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”).

    1. I agree that I am taking this tour voluntarily and that I am in good physical health and do not suffer from any known physical disability or condition that would prevent or otherwise limit my full participation in the Tour.

    2. I understand and accept that there are risks to walking in public that are beyond the reasonable control of any party. I hereby elect to voluntarily participate in the Tour knowing that the associated physical activity may be hazardous to me and/or my property. I voluntarily assume full responsibility for any risks or loss, property damage or personal injury, including death, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in this Tour.

    3. I release, waive, discharge and covenant not to sue Lifesavers, the party providing the Tour, or any of their officers, servants, employees, agents, or contractors (“Released Parties”), from any claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained by me, or to any property belonging to me, while participating in the Tour, or while on or upon any premises where the Tour is being conducted including, but not limited to any claims arising under negligence (“Claims”).

    4. I further agree to INDEMNIFY, HOLD HARMLESS, AND DEFEND Lifesavers in any action or proceeding arising from my participation in the Tour, or for my failure to comply with the terms of this Waiver and Release. This agreement to indemnify, hold harmless, and defend applies even if the act or omission complained of was allegedly caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

    5. In the event that I am physically injured or otherwise require medical attention during the Tour, Lifesavers can arrange for medical attention, but they are not obligated to do so and they will not be liable for any resulting care received.
    6. If a court of competent jurisdiction rules that any part of this waiver is invalid or unenforceable, the remainder of the waiver will not be affected and will remain enforceable.

    7. If I have agreed to having my picture or recording taken by Lifesavers during the walking tour, I agree that Lifesavers can use my image, likeness, as well as recordings of me in any format to promote Lifesavers and Lifesavers will not be required to provide me with any compensation for using my image, likeness, or recordings of me in this manner.

    8. In signing this waiver and release, I acknowledge that I have read and understand the foregoing and hereby sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreements have been made; and I hereby execute this release for valuable consideration, intending to be bound by the same.

    9. This Waiver and Release is subject to the laws of the Commonwealth of Virginia.
